In Florida you can basically get a divorce
by asking, ie you do not have to prove much of anything. You do have to
show though that one of the parties has resided in Florida for at least
the six month period immediately preceeding the filing of papers. Also,
the marriage must be "irretrievably broken". (a Judge can order
counseling before granting the dissolution of marriage but that is
pretty rare).
Most people want to get through the divorce process with as little aggravation as possible, especially where children are involved. A responsible divorce lawyer will indicate to you that you will save a lot of time, money, and aggravation by working out as many issues as possible with your spouse before going to Court. If you can settle all issues with your spouse, the attorney can draw up a Marital Settlement Agreement which the Judge will incorporate into the Final Judgment of Divorce. Those issues include things like child support, custody, visitation, health insurance for children, life insurance so that there will be money for children if the parent paying support dies, division of debts and property, including the marital home, and alimony. Sometimes a mediator can help settle issues. The issues that cannot be worked out will be decided by the judge during a trial without a jury.
